The Florida difference

Your permit comes from your county

Florida runs biomedical waste through Chapter 64E-16 of the Florida Administrative Code, and the permit does not come from Tallahassee. A facility applies annually to the county health department where the business sits, so a practice in Crestview deals with Okaloosa and one in Freeport deals with Walton.

Two numbers matter after that. A facility that can document less than 25 lbs of biomedical waste in every 30-day period over the previous twelve months can qualify for an exemption from the permit, though the rest of the rule still applies. And nothing may sit at the generating facility for more than 30 days, which is what the pickup schedule has to keep up with.

What Florida asks of you

Florida calls it biomedical waste and runs it through Chapter 64E-16 of the Florida Administrative Code. A short guide, for orientation.

  • A permit from your county

    Facilities that generate biomedical waste apply for an annual permit to the county health department where the business sits. Here that is your county health department.

  • The 25-pound exemption

    A facility that can document less than 25 lbs in every 30-day period over the previous 12 months can qualify for an exemption from the permit. The rest of the rule still applies.

  • 30 days on site

    Biomedical waste may not be stored at the generating facility for more than 30 days, so the pickup schedule has to keep up.

  • A plan and trained staff

    Facilities keep a written biomedical waste operating plan. Staff are trained before they handle the waste and take a refresher every year.

Do I need a biomedical waste permit in Florida?

Most facilities that generate biomedical waste need an annual permit from the health department in their county. A facility documenting less than 25 lbs in every 30-day period over the previous 12 months can qualify for an exemption, but still follows the rest of Chapter 64E-16.

How long can biomedical waste stay on site?
